APPLICATION FORM IN ACCORDANCE WITH ARTICLES 11 AND 13 OF THE LAW ON THE PROTECTION OF PERSONAL DATA

Personal data owners, defined as data subjects in the Law No. 6698 on the Protection of Personal Data (hereinafter referred to as "Applicant"), are granted the right to make certain requests regarding the processing of their personal data in Article 11 of the Law.

In accordance with the first paragraph of Article 13 of the Law, applications regarding these rights must be submitted to our company, which is the data controller, in writing or through other methods determined by the Personal Data Protection Board.

Your application and the request contained therein will be processed by TARIK EDİZ, the data controller, free of charge, as soon as possible and no later than thirty days, depending on the nature of the request. However, if the process requires additional costs, a fee may be charged according to the tariff determined by the Board. Your request will be accepted or rejected with justification within this period, and the response will be communicated to you in writing or electronically.

The information and documents you have provided in the application form will be processed by TARIK EDİZ solely for the purposes of evaluating and responding to your application, delivering the response to you, and verifying your identity and address, as outlined in this privacy policy.

According to Article 7 titled “Fee” of the Communiqué on the Procedures and Principles for Applications to the Data Controller, “(1) If the response to the data subject’s application is to be given in writing, no fee will be charged for up to ten pages. A processing fee of 1 Turkish Lira may be charged for each page exceeding ten pages. (2) If the response to the application is given on a recording medium such as a CD or flash drive, the fee that may be requested by the data controller cannot exceed the cost of the recording medium.”

As Kadir Tarık Ediz Teks. San. Ve Tic. A.Ş. (hereinafter referred to as “Tarık Ediz”), we take utmost care to ensure the confidentiality and security of the personal data of all our customers and visitors in accordance with the Constitution of the Republic of Turkey, the Law No. 6698 on the Protection of Personal Data, and other relevant legislation. Your personal data is processed by us as the “Data Controller” in accordance with the provisions of the Law No. 6698 on the Protection of Personal Data and related legislation, within the framework outlined below.

1. Who is responsible for the security and processing of your personal data?

As Tarık Ediz, we are responsible for the security of all personal data you provide to us, in our capacity as "data controller" in accordance with the Law No. 6698 on the Protection of Personal Data.

 

2. For what purposes are your personal data processed?

Your personal data is processed primarily to fulfill the obligations imposed on us by legislation, including but not limited to the Turkish Commercial Code No. 6102 and the Tax Procedure Law No. 213.

Your personal data is processed not only to fulfill our legal obligations, but also to ensure data security, to provide the highest level of service and products you request, to provide after-sales support for the products and services offered, to ensure your profile is ready for your next service and product request, and to quickly and accurately determine the most suitable services and products for you, all with the aim of ensuring customer satisfaction, which is our most important principle.

Your personal data may also be processed for purposes such as improving the products and services we offer, announcing our products and campaigns, planning, executing and managing our management and communication activities and strategies, improving the services offered on the website, resolving errors on the site, increasing service quality, enabling third parties to perform technical, logistical and other similar functions on our behalf as service providers, and ensuring that your payments are processed quickly and securely when necessary.

3. To whom and for what purposes can your personal data be transferred?

Persons essential for the performance of the service

Your personal data may be shared with our business and solution partners, banks, and third parties who perform technical, logistical, and similar operations on our behalf, only to the extent that it is appropriate to the nature of the service and to ensure that the services provided to you are complete and flawless. These third parties are limited to those who have access to the relevant information in order to ensure the complete and flawless provision of the services.

Individuals legally required to be shared

Your personal data may also be transferred to Tarık Ediz – and only to the relevant person or institution – in cases where it is necessary for him to fulfill his legal obligations, when it is explicitly provided for in the laws, or when there is a judicial/administrative order issued in accordance with the law.

Consulting and support service providers

Your personal data may be transferred to third parties from whom we receive support in areas such as storage, archiving, IT support, security, and call centers; to business partners with whom we cooperate and/or receive services; to banks and financial institutions; to law firms and consulting firms from whom we receive support in legal, tax, and similar areas; and to other related parties and authorized institutions and organizations where the transfer is necessary for the purposes specified, solely for the purposes of protecting Tarık Ediz's rights and/or your rights and fulfilling legal obligations.

Agencies and advertisers

Some personal data may be shared with advertisers in an aggregated, anonymized form, only in conjunction with information from other users, to enable targeted advertising. Anonymized data is information that cannot be matched to you, our visitors/customers, and does not contain or identify your personal information. Your privacy is protected in anonymized data.

4. By what methods and on what legal grounds are your personal data collected?

Your personal data is collected through forms you fill out in our stores or on our website, information you provide to us through our store representatives or via mail, email, fax, and similar means, voice calls you have with us, or meetings you have in person at our company. The collected personal data is gathered in accordance with the nature of the data, for the purposes stated above, to enable us to provide our services and to fulfill our contractual and legal responsibilities completely and accurately, primarily to fulfill the obligations imposed on us by legislation such as the Turkish Commercial Code No. 6102, the Tax Procedure Law No. 213, the Consumer Protection Law No. 6502, and the Personal Data Protection Law No. 6698.

The legal grounds for collecting your personal data within this scope are determined in accordance with the nature of the data and may be one of the following: explicit consent, explicit provision in the law, necessity of data processing for the performance of a contract, necessity for fulfilling our legal obligations, or necessity of data processing for the legitimate interests of the data controller.
 

5. What are your rights regarding your personal data?

According to the Law No. 6698 on the Protection of Personal Data, everyone has the right to apply to the data controller for information about themselves;

1. To find out whether your personal data is being processed,
2. The right to request information regarding the processing of personal data.
3. To learn the purpose of processing personal data and whether it is being used appropriately for that purpose.
4. Knowing the third parties to whom personal data is transferred, whether domestically or internationally.
5. Requesting the correction of personal data if it has been processed incompletely or inaccurately.
6. You can request the deletion or destruction of your personal data when the reasons requiring its processing no longer exist.
7. Requesting that the actions taken pursuant to clauses (d) and (e) be notified to third parties to whom personal data has been transferred.
8. The right to object to an outcome that is detrimental to oneself, resulting from the analysis of processed data exclusively through automated systems.
9. Individuals who suffer damages as a result of the unlawful processing of their personal data have the right to claim compensation for those damages.

Your request must clearly state the right/request you wish to exercise, along with your identification information, and include all relevant information and documents, along with necessary explanations.

Requests that meet the required criteria will be processed within a maximum of 30 (thirty) days, depending on the nature of the request, and the result will be communicated to you in writing or electronically, in accordance with the feedback method you selected in your request.
